Florida Probate Administration Options

The appropriate procedure depends on the estate’s assets, debts, governing documents, and other circumstances. You don’t need to determine which process applies before contacting me.

Florida estate proceedings may include:

  • Formal administration: The standard court-supervised process for many estates, particularly those involving substantial assets, creditor issues, or other complications.
  • Summary administration: A streamlined procedure that may be available when an estate meets Florida’s eligibility requirements.
  • Ancillary administration: A proceeding that may be necessary when someone who lived outside Florida died owning real estate or other property in the state.
  • Disposition without administration: A limited procedure available only in certain small-estate circumstances defined by Florida law.

Before recommending a path, I consider the date of death, the existence of a will, the nature and location of the property, potential creditor claims, and any disagreements that could affect the estate.

What Orlando Estate Administration Involves

Estate administration requires more than submitting a will to the court. I assist with locating and securing assets, notifying creditors, evaluating claims, and distributing property to the proper beneficiaries.

Additional coordination may be necessary when real estate must be managed or sold, an account is difficult to locate, a beneficiary can’t be found, or tax questions require input from a qualified tax professional.

Where Orlando Probate Matters Are Filed

The Orange County Clerk of Courts processes probate filings, maintains official records, collects filing fees, and provides certified copies. Clerk staff can process documents, but they can’t choose the appropriate procedure or provide legal advice.

Venue depends on facts such as the decedent’s residence and the location of Florida property. If a non-Florida resident owned property in Orange County, that property may support an Orange County proceeding. I evaluate jurisdiction and venue before preparing filings for an Orlando-area estate.
